Thank you for your interest in using the online digital self-expression service operated by mEgo, Inc. ("mEgo"). Your privacy is important to us and we have prepared this Privacy Policy to explain to you how we collect, use, and share information we obtain through your use of http://www.mego.com (the "Site"). Except to the extent otherwise required to comply with the Safe Harbor Program set forth in Section 11 below, this Privacy Policy does not govern our use of any information you provide to us when you call us, write to us, or communicate with us in any manner other than through the Site. Because the Internet is global, information about you that we collect or that you submit may be transferred to, processed in, and held in countries (including the United States of America) other than the one in which you reside. By using the Site, you explicitly consent to such use of your information and agree to the terms of this Privacy Policy. This Privacy Policy is effective as of November 20, 2006. This Privacy Policy was last updated on February 21, 2008.

  1. Information We Automatically Collect. We automatically collect certain information to help us understand how our users use the Site (which we will refer to in this Privacy Policy collectively as "Usage Data"). For example, each time you visit the Site we may automatically collect your IP address, browser and computer type, access time, the webpage from which you came, and the webpage(s) that you access during your visit. We also use cookies (which are small amounts of data sent from a web server to your browser that are stored on your computer's hard drive) to keep track of your use of the Site, to validate your identity, to remember your password and preferences, to tailor the Site to meet your personal interests, and to improve the quality of the Site. We do not link the information we store in cookies to any Personal Information (as defined below) that you provide to us through the Site. In addition, third parties who place advertisements on the Site may also collect information through cookies to ensure that their advertising systems and technologies work properly and to allow them to track responses to their advertisements. Cookies set by these third parties are governed by the privacy policies of those third parties.   2. Information You Choose To Submit. You can visit the Site without telling us who you are or revealing any information (such as your name, e-mail address or telephone number) by which someone could personally identify you (which we will refer to in this Privacy Policy collectively as "Personal Information"). If however, you wish to register to become a member of the Site, you are required to provide certain Personal Information (e.g. your e-mail address) and we ask that you also provide a user name and password. We use your Personal Information to fulfill your requests for products and services, to improve our services, and to contact you from time to time about us, our Site, and our products and services. By registering to become of a member of the Site, you are automatically opting in to receive emails from mEgo. You may also choose to submit additional Personal Information or other information about yourself (such your hobbies, favorite band, age, or high school) that would not enable someone to personally identify you but that you wish to share to personalize your pages on the Site (which we will refer to in this Privacy Policy collectively as "Other Information").If you choose to use our referral service to tell a friend about our Site, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. We store this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Your friend may contact us as follows to request that we remove this information from our database, and we will respond to such request within 10 calendar days:

  3. Our Information Sharing Practices.
    • Generally. Except as otherwise described in this section of our Privacy Policy, we will never share your Usage Data, Personal Information or Other Information (which we will refer to in this Privacy Policy collectively as "User Information") with any third party without your permission.
    • Advertisers. We may share your Usage Data and Other Information to enable third parties who serve advertisements on the Site to deliver advertisements that will be relevant to you. We will not share any such information in a manner that would enable the advertiser to personally identify you.
    • Aggregated Data. We may share aggregated User Information with third parties. We will not share any aggregated data, however, in a manner that would enable the recipient to personally identify you.
    • Service Providers. We may enter into relationships with third parties who provide services to us (e.g., data management and storage services). In those circumstances, we disclose User Information that is necessary for such service providers to perform those services and require that they maintain the confidentiality of such User Information.
    • Other Disclosure Scenarios. Notwithstanding anything in this Privacy Policy to the contrary, we reserve the right to share any User Information: (i) in response to subpoenas, court orders, or legal process, or to establish, protect, or exercise our legal rights or defend against legal claims; (ii) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person or property; (iii) if we believe it is necessary to investigate, prevent, or take action regarding significant abuse of the Site's infrastructure or the Internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of information); (iv) to our parent company, subsidiaries, joint ventures, or other companies under common control with us (in which case we will require such entities to honor this Privacy Policy); and (v) if we are acquired by or merged with another entity.
  4. Public Areas. Your use of areas of the Site that are intended for interaction with other users (e.g., message boards, discussion rooms, and other online forums) may allow you to post Personal Information and Other Information. By choosing to use these areas, you understand and agree that anyone may access, use, and disclose any Personal Information or Other Information that you post to those areas. For example, by choosing to post any information in your Social mEgo, you understand and agree that such information will be accessible through the Site and any other web site through which you have elected to share your Social mEgo.
  5. Tell a Friend. If you choose to use our referral service to tell a friend about our site, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. Mego, Inc stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Your friend may contact us at privacy@mego.com to request that we remove this information from our database.
  6. Choice/Opt-Out. We offer you the opportunity to choose not to receive communications from us. If you would like to take advantage of this opportunity, please let us know by logging into your account, selecting "My Settings", and clicking on one of the following options based on your communication preference: "Do not send me mEgo news and info emails", or "Do not send me notifications when I receive notes", or "Make my mEgo private". Please note that sometimes these requests may take up to 10 calendar days to process and that we are not responsible for removing information about you from the database of any third party to whom we were authorized to disclose your User Information prior to processing your request. Even if you do take advantage of this opportunity, we reserve the right to send you administrative messages relating to the Site (e.g., about changes to this Privacy Policy) and to contact you regarding any goods or services you have ordered.
  7. Correcting, Modifying and Deleting Your Personal Information.If you would like to correct, modify or delete from our database, any Personal Information or Other Information you previously submitted to us, please let us know by accessing and updating your profile by: (i) logging into your account; (ii) selecting "My Settings"; (iii) making the relevant changes that you wish to make; and (iv) then clicking on "Submit Changes". You changes will be accepted within 10 calendar days. Please note that any Personal Information or Other Information that we have copied may remain archived in our databases or in back-up storage for some period of time after your request, even after it has been removed from view, and that if you delete certain information you may not be able to order services in the future without re-submitting such information. Also, please note that we will maintain User Information in our database whenever we are required to do so by law.
  8. Security. We have implemented reasonable measures to help protect your User Information from loss, misuse, or unauthorized access or disclosure. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your User Information, we cannot guarantee its security.
  9. Links.The Site may contain links to other web sites. We are not responsible for the privacy practices of any such other web sites and urge you to review such other web sites' privacy practices prior to submitting any information to such web sites.
  10. Children's Privacy. We are committed to protecting the privacy needs of children and we encourage parents and guardians to take an active role in their children's online activities and interests. The Site is not intended for, and may not be used by, children under the age of 13. We do not knowingly collect information from children under the age of 13 and we do not target the Site to children under the age of 13.
  11. Changes. We reserve the right to modify this Privacy Policy at any time, so please review it frequently. If we make material changes to this Privacy Policy, we will notify you here, by email or by means of a notice on our home page. Any updated version of this Privacy Policy will be effective as of the date set forth therein.

Safe Harbor Program. mEgo participates in the Safe Harbor Program developed by the European Union Commission and the United States Department of Commerce regarding the collection, use, and retention of data from the European Union. Accordingly, we have certified that we adhere to the Safe Harbor Privacy Principles. If you have any questions or concerns regarding our compliance with the Safe Harbor Program, please contact us as indicated below. For more information about the Safe Harbor Program and to view our Safe Harbor Program compliance certification, please visit the U.S. Department of Commerce's Safe Harbor Program web site. As part of our participation in the Safe Harbor Program, we have agreed to TRUSTe dispute resolution for disputes relating to our compliance with the Safe Harbor Program. Because mEgo wants to demonstrate our commitment to your privacy, we have agreed to disclose our information practices and have our privacy practices reviewed for compliance by TRUSTe.     The TRUSTe program is consistent with government and industry guidelines concerning the use of your personal information.
